No relaxation from TET ( Teacher Eligblity Test) is Possible
सी टी ई टी / टी ई टी से छूट तो स्वयं कोर्ट भी नहीं दे सकती , क्यूंकि आर टी ई एक्ट संविधान का एक हिस्सा है ,
और केंद्र सरकार के गजट नोटिफिकेशन में प्रकाशित है ।
अब यह छूट संविधान में परिवर्तन के तहत ही मिल पाएगी

मेरा कहना है की आर टी ई एक्ट के तहत शिक्षक बनने के लिए टी ई टी / सी टी ई टी से छूट किसी को नहीं अगर समुचित मात्रा में योग्य टी ई टी
पास शिक्षक उपलब्ध है तो ।

अभी हाल ही में नैनीताल हाई कोर्ट ने निर्णय दिया है की टी ई टी से छूट तो एन सी टी ई और उत्तरांचल राज्य सरकार भी नहीं दे सकती ,

उत्तर प्रदेश में भी दो बार ट्रिपल बेंच बैठ चुकी है जिसमें एक ट्रिपल बेंच ( तीन जजों की बेंच) खास तोर से टी ई टी में छूट देने के सन्दर्भ में बनाई गयी थी ।
जिसमें साफ़ किया गया की टी ई टी से छूट संभव नहीं

सीटैट के बगैर भी बन सकेंगे शिक्षक 

केंद्रीय शिक्षक पात्रता परीक्षा (सीटैट) पास किए बगैर भी आप शिक्षक बन सकते है। केंद्रीय प्रशासनिक पंचाट (कैट) ने शिक्षकों की कमी दूर करने के लिए केंद्र व दिल्ली सरकार से शिक्षक नियुक्ति में सीटैट की अनिवार्यता में छूट देने का निर्देश दिया है। पंचाट ने सरकार से सीटैट की जगह अनुभव को तरजीह देने का निर्देश दिया है।

पंचाट के न्यायिक सदस्य ए.के. भारद्वाज और बिरेंद्र कुमार की पीठ ने यह आदेश सीटैट की योग्यता नहीं होने की वजह से नौकरी से निकाले गए ठेका पर कार्यरत शिक्षकों की ओर से दाखिल याचिका का निपटारा करते हुए दिया है। पीठ ने अपने फैसले में शिक्षा के अधिकार अधिनियम की धारा-23 का हवाला देते हुए कहा है कि प्रशिक्षित शिक्षकों के अभाव में केंद्र सरकार अधिसूचना जारी कर शिक्षकों की नियुक्ति में शिक्षक पात्रता परीक्षा पास करने की अनिवार्यता में छूट दे सकती है।

पीठ ने सरकार से सभी याचिकाकर्ताओं को दोबारा नौकरी देने पर विचार करने का निर्देश दिया है। गौरतलब है कि केंद्रीय प्रशासनिक पंचाट में केंद्र सरकार और केंद्र शासित प्रदेशों में नियुक्ति, प्रमोशन एवं अनुशासनात्मक कार्रवाई से संबंधित विवादों का निपटारा किया जाता है।

कॉन्ट्रैक्ट / ठेका कर्मियों को बगैर टेट हटाया जा रहा था और उसके बारे में केंद्र सरकार  की ट्रिब्यूनल कोर्ट ने निर्णय दिया है , अगर
प्रशिक्षित (टेट पास ) कर्मी नहीं मिलते है , तो अप्रशिक्षितों से काम चलाया जा सकता है ।
हिंदुस्तान  में बहुत सारे विभागों के अपनी कोर्ट स्वयं होती है , जिस से वह जल्द फैसले दे कर काम काज में आ रही बाधा को हटा सकें ,
ऐसे ही केंद्र सरकार ने केंद्रीय प्रसाशनिक प्राधिकरण  ( सेंट्रल एडमिनिस्ट्रेटिव ट्रिब्यूनल ) बना रखी है ।

संविधान के तहत न्याय पाने के लिए उस से ऊपर हाई कोर्ट , फिर सुप्रीम कोर्ट है

SC seeks response of Centre, states on violation of Right to Education Act

Petition asked the states and the UTs to recruit and train one lakh additional professionally trained teachers every month.
   

The PIL, filed by the National Coalition for Education — a network of organisations fighting for the RTE — said at least 1.5 lakh schools and 12 lakh trained teachers were required to fulfill the goals envisaged under the RTE.

 It sought a direction that "the states and UTs upgrade all deficient schools with appropriate physical infrastructure so as to be in compliance with the RTE Act within six months.

"The states and UTs regularise and make permanent all contract and para-teachers in the country," it said. The petition also said the states and UTs should disclose the number of students admitted under the Economically Weaker Section (EWS) quota in the state in accordance with the provisions of the Act. 





 
A bench headed by Chief Justice P Sathasivam issued notice and sought their response after summer vacation on a plea filed by an organisation, National Coalition for Education.
  
The plea said lack of resources and failure to implement provisions of the RTE Act has resulted in a significant decline in education performance.
  
Senior advocate Colin Gonsalves sought a direction to all the states to complete the required neighbourhood mapping within six months and new schools be constructed six months after completion of the process.
  
The petition asked the states and UTs to recruit and train one lakh additional professionally trained teachers to end the shortage of educators within a year.
  
It sought a direction that "the states and UTs upgrade all deficient schools with appropriate physical infrastructure so as to be in compliance with the RTE Act within six months.
  
"The states and UTs regularise and make permanent all contract and para-teachers in the country," it said.
  
The petition also said the states and UTs should disclose the number of students admitted under the Economically Weaker Section (EWS) quota in the state in accordance with the provisions of the Act.
  
"Based on the aforementioned facts, it is clear that the Right to Education is being violated across the country. These violations have persisted for years and remain today in face of the RTE Act's requirement that they be remedied within three years of it coming into force.
  
"And more troubling, they persist despite widespread awareness of their existence by various responsible governments and authorities and in the face of previous orders from this court on October 3, 2012 to remedy them," it said

याचिकाकर्ता ने लगाया है शिक्षा का अधिकार कानून के उल्लंघन का आरोप 

नई दिल्ली (ब्यूरो)। देशभर के स्कूलों में शिक्षकों और संसाधनों की कमी के चलते शिक्षा के अधिकार कानून (आरटीई) के उल्लंघन के आरोप पर सुप्रीम कोर्ट ने शुक्रवार को केंद्र व सभी राज्य सरकारों से जवाब तलब किया। सर्वोच्च अदालत में दायर याचिका में इस कानून पर सही तरीके से अमल कराने के लिए सरकारों को निर्देश जारी करने की मांग की गई है।
चीफ जस्टिस पी. सदाशिवम की अध्यक्षता वाली पीठ ने केंद्र, राज्य व केंद्र शासित प्रदेशों को नोटिस जारी कर ग्रीष्मावकाश के बाद जवाब दाखिल करने को कहा है। याचिका नेशनल कोलीशन फॉर एजुकेशन संगठन ने दायर की है। याचिका में कहा गया है कि संसाधनों की कमी और आरटीई के प्रावधानों को लागू करने में विफलता के कारण शिक्षा के क्षेत्र में काफी गिरावट आई है। पीठ के समक्ष वरिष्ठ अधिवक्ता कोलिन गोंसाविस ने सभी राज्यों को छह महीने के भीतर दूर-दराज के इलाकों का अध्ययन करने का निर्देश जारी करने का आग्रह किया। साथ ही कहा कि यह प्रक्रि या पूरी होने के बाद छह महीने के लिए नये स्कूलों का निर्माण होना चाहिए।

The HP state subordinate service selection board has decided to recruit trained graduate teachers (TGTs medical and non-medical both), and shashtri teachers through a written test following which the interviews would be held.


A spokesman on Tuesday said that there would be 361 posts of shashtri teachers and 417 of trained graduate teachers.

Those eligible can apply online on or before November 28, 2013. However, the closing date for candidates of far-flung areas would be December 13, 2013. Candidates have to qualify the teacher eligibility test (TET) to apply for the above posts. All those applying are exempted from the application fee and would be selected based on their performance in the written examination.

Candidates who wish to apply have to download the application form from the official website of the HPSSSB at www.himachal.nic.in. The application downloaded should be filled by the candidate with required details and should submit the same without errors. On successful submission, candidates have to note the unique registration number generated through the system. Candidates should also possess a passport size photo and all other related certificates to ensure their eligibility  for the post.

They should also take a print out of the confirmation page, which would be available on successful submission of the application form.

A printout of the application has to be attached with a passport size photo and other valid documents of the applicant and must be sent to the secretary, HP Subordinate Services Selection Board, Hamirpur.

Himachal Pradesh chief minister Virbhadra Singh reportedly asked the education department to allow the junior basic trained (JBT) teachers of the 2011-13 batch to appear in the teacher eligibility test (TET) in view of a recent judgment of the Allahabad high court.

This was stated by Vijay Kumar Heer, the state president of Himachal Kranti Manch here on Wednesday. Heer said he had taken up the issue with the chief minister and, accordingly, the CM gave the direction to the education department. He demanded from the education department to give decision with immediate effect. Heer said the high court had allowed a number of NCTE candidates to appear in the TET in Utter Pradesh.

The TET would be held on August 11 and a final announcement in the wake of the recent order of the chief minister was expected before that.

शिमला। प्रदेश के विभिन्न स्कूलों में सेवाएं दे रहे 3482 प्राथमिक सहायक अध्यापकों (पैट) के नियमितिकरण पर तलवार लटक गई है। नए भर्ती-पदोन्नति नियमों के अनुसार अब इन्हें टीचर्स एलिजीबिलिटी टेस्ट (टीईटी) पास करना होगा। इन्हें प्रशिक्षण देने का काम पूरा हो चुका है। 

प्रारंभिक शिक्षा विभाग के निदेशक एचआर शर्मा के अनुसार आरटीई एक्ट के अनुसार टीईटी परीक्षा पास करना जरूरी है। यह शर्त पैट पर भी लागू होगी। केंद्रीय कानून होने के कारण प्रदेश स्तर पर इसमें संशोधन नहीं किया जा सकता। यदि केंद्रीय मंत्रालय नियमों में छूट दे, तो पैट शिक्षकों को राहत मिल सकती है।

इसी माह पूरा किया था 52 दिन का प्रशिक्षण

सरकार ने पैट शिक्षकों को 52 दिन का प्रशिक्षण दिया है। यह प्रशिक्षण इसी माह पूरा हुआ है। इससे पैट शिक्षकों को जेबीटी के पद पर तैनाती दी जा सकती है। हालांकि, नए नियमों के शिक्षकों को अब टीईटी परीक्षा को पास करना होगा।

आरटीई एक्ट से परेशानी

आरटीई एक्ट के अमल में आने से अब शिक्षकों को टीईटी परीक्षा पास करनी होगी। यह परीक्षा पैट शिक्षकों को भी देनी होगी। पैट को इससे तभी छूट मिल सकती है, जब प्रदेश सरकार इस मामले को केंद्रीय मंत्रालय से छूट दिलाए।

शिक्षक संघ नाराज, महाधिवेशन में उठाया जाएगा मुद्दा

हिमाचल प्रदेश प्राथमिक सहायक संघ के अध्यक्ष सुनील चौहान के अनुसार शिक्षक 52 दिन की ट्रेनिंग पूरी कर चुके हैं। पूर्व सरकार ने 1400 शिक्षकों को तो नियमित किया था, लेकिन कांग्रेस शासनकाल में लगे 3482 शिक्षकों को इससे अलग रखा गया। जब उनकी भर्ती हुई थी, तो उस समय आरएंडपी रूल अलग थे। ऐसे में उन पर टीईटी की शर्त लागू नहीं होती। मुख्यमंत्री वीरभद्र सिंह ने उनको नियमित करने का आश्वासन दिया है, जिसके लिए संघ जल्द महाधिवेशन का आयोजन करेगा

After all to make quality in Teachers, Himachal Govt. make TET Qualifications mandatory to get PROMOTION.

However many employee may oppose it due to the fact that their collegues / seniors etc. gets promotion on the basis of seniority. Then why such examination is for them only.And it is new rule for them etc. etc.

Earlier TET is mandatory to become teacher, now a new trend comes to make quality in Education.

I think TET concept comes after success of UGC NET concept.

Recently many organizations make common examination all over India like IBPS implemented - CWE (Common Written Examination ) for Officers and Clerks.

Almost all PSU (HPCL, NTPC, ONGC, SAIL etc.) using GATE Aptitude Examination for screening of Candidates. This examination gives equal chance to all candidates to perform on same platform.

DRDO uses SET ( Scientist Entrance Test). SET exam is designed by IITs in India.

For engineering also, a new concept is coined recently like a common examination which covers IIT and all other engineering colleges. Before this IITs conducts separate exams, CBSE conducts AIEEE and states in India conducts their separate exams. This new concept opposed by IIT Kanpur with a fact that UP Board candidates gets less marks comparing to other Boards. And after this a scaling system adopts to make equality in different Boards.

Therefore India is going slowly in new dimensions of Common Examination system for officers/employees/and other entrances.
